Agreement to Terms

By accessing and using the vivtorexcrex website and photography services, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use our services.

Photography Services

vivtorexcrex provides portrait and lifestyle photography services in Auckland, New Zealand. All services are subject to availability and require prior booking. We reserve the right to refuse service for any reason.

Booking and Payment

Photography sessions require a deposit to secure your booking. Full payment is due as specified in your booking agreement. Cancellation policies apply as outlined at the time of booking. Refunds are subject to our return policy.

Image Rights and Usage

All photographs taken by vivtorexcrex remain the property of the photographer. Clients receive usage rights as specified in their service agreement. Unauthorized reproduction, distribution, or commercial use of images is prohibited without written permission.

Client Responsibilities

Clients are responsible for:

  • Arriving on time for scheduled sessions
  • Providing accurate information and requirements
  • Following any preparation guidelines provided
  • Respecting the photographer's equipment and workspace

Consumer Guarantees Act 1993

Our services are provided in accordance with the Consumer Guarantees Act 1993. This means:

  • Services will be provided with reasonable care and skill
  • Services will be fit for the purpose for which they are supplied
  • Services will be completed within a reasonable time
  • If services fail to meet these guarantees, you may be entitled to a remedy

Nothing in these Terms of Use limits or excludes your rights under the Consumer Guarantees Act 1993 where those rights cannot be excluded by law.

Fair Trading Act 1986

We comply with the Fair Trading Act 1986, which prohibits misleading and deceptive conduct in trade. All information provided about our services is accurate to the best of our knowledge. If you believe any information is misleading, please contact us immediately.

Limitation of Liability

To the maximum extent permitted by New Zealand law, vivtorexcrex shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

This limitation does not affect your rights under the Consumer Guarantees Act 1993 or any other rights that cannot be excluded by law.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of any modified terms.
